Terms of Service

Hosted SaaS terms for PDFService: simple electronic signatures (SES only — not AES, not QES), usage credits, and access via browser, agents, and API.

1. Agreement

PDFService is a Hyper Garden product operated at pdfservice.ai. By creating an account, accessing the website, or using the API or MCP interfaces, you agree to these Terms of Service. If you use PDFService on behalf of an organization, you represent that you have authority to bind that organization.

2. The service

PDFService is a hosted software-as-a-service platform for electronic signatures on PDF documents and related document operations. We operate the service at pdfservice.ai. These terms do not grant a license to install or host the platform yourself.

  • Upload PDFs and place signature fields
  • Run placement ceremonies — several invited people place visible signatures, dates, and text on a set of documents
  • Invite signers and authenticate them with email one-time codes
  • Capture consent to sign electronically
  • Produce cryptographically signed, tamper-evident PDFs
  • Provide audit records of the signing process
  • Programmatic access via API and agent (MCP) tools
  • Usage metering in account credits

3. Electronic signatures — SES only

We produce cryptographically signed, tamper-evident PDFs using PAdES-format packaging under a platform-managed certificate. That technical packaging supports our SES product only.

  • Signatures are offered as simple electronic signatures (SES) for ordinary business use only
  • We do not claim Advanced Electronic Signatures (AES): the signing private key is held by the service after email verification and consent — not under the signer’s sole cryptographic control
  • We do not provide Qualified Electronic Signatures (QES), are not a QTSP, and do not operate a QSCD — QES is not supported
  • Email one-time codes authenticate access to the signing session; they are not government identity proof
  • Placement ceremonies flatten drawn or imported signature images, dates, and text into the PDF visually — no cryptographic seal is applied to placement output
  • You are responsible for whether a particular document and process meet your legal needs
  • Platform certificates may display as untrusted in some PDF viewers until a separately offered CA-anchored option is used — viewer UI is not the sole measure of legal validity, and a completed signature is not AES or QES

4. Accounts, API keys, and agents

  • Provide accurate account information and keep credentials confidential
  • API keys and agent configurations authenticate as your account
  • You are responsible for all activity under your keys, including actions initiated by AI agents you configure
  • Do not share keys publicly or embed them where third parties can extract them

5. Credits and payment

  • Certain actions consume credits according to the current catalog
  • The default billable event is a successfully completed signature request (typically one credit for the first completed signer)
  • The account-activation credit, if granted, is promotional and one-time
  • Purchased credit packs add durable credits to your hosted account balance until used
  • We do not sell per-user seat licenses as the primary model
  • Paid credits and Enterprise commitments are billed through our payment provider or invoice as agreed
  • Credits are not legal tender; refunds follow the refund policy and applicable law

6. Acceptable use

You may not use the service to:

  1. Violate law or third-party rights
  2. Send fraudulent, deceptive, or phishing signature requests
  3. Distribute malware or illegal content
  4. Bypass authentication, consent, audit logging, or credit metering
  5. Probe or attack the service except via coordinated vulnerability disclosure
  6. Impersonate persons or entities, or claim AES, QES, QTSP status, or other regulated trust services we do not provide
  7. Spam or flood signers with unsolicited signature requests

7. Availability and data

We use commercially reasonable efforts to operate the service. We do not guarantee uninterrupted availability. Enterprise SLAs apply only if stated in a separate written agreement.

Processing of personal data is described in the Privacy Policy. You are responsible for rights in documents you upload and for consents from signers and counterparties.

8. Intellectual property

We and our licensors own the service, software, and branding. You retain ownership of your document content. You grant us a limited license to host, process, transmit, and display content solely to provide the service and as required by law.

9. Disclaimers and liability

The service is provided “as is” and “as available” to the maximum extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any particular signature will be enforceable in a specific dispute or jurisdiction.

To the maximum extent permitted by law, our total liability arising out of or related to the service is limited to the amounts you paid us for the service in the twelve (12) months before the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, even if advised of the possibility.

10. Suspension, changes, and contact

We may suspend or terminate access for violations, unpaid fees, abuse, legal risk, or service misuse. You may stop using the service at any time.

We may update these Terms; material changes will be noticed by email or in-product notice where practicable. Continued use after the effective date constitutes acceptance.
